font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">a.  will also cover a claim by a third party which relates solely to damage sustained to the third party’s motor vehicle arising as a result of Your use of the Motor Vehicle;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">b.  will not cover a claim by a third party for damage to any other property (other than their motor vehicle) including any other Equipment or other items (owned by You or a third party) which may be on or in the Motor Vehicle; and\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">c.  will not cover a claim by a third party arising out of the Motor Vehicle being lost or stolen.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">2)  Clause 13.6 of the Terms of Hire is deleted and replaced with the following:\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 80px;\">A.  We will not waive Our rights to claim against You for loss, theft or damage to the Motor Vehicle, and the LTD Waiver will not apply where the loss, theft or damage to the Motor Vehicle has arisen as a result of or has been caused by:\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">a.  Your breach of a clause of this Hire Agreement;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">b.  Your intentional or reckless act or omission whilst using the Motor Vehicle;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">c.  Your use of the Motor Vehicle in violation of any laws (other than a minor traffic offence which does not automatically result in the loss of the drivers’ licence of the driver of the Motor Vehicle);\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">d.  Your failure to use the Motor Vehicle for its intended purpose or in accordance with Our instructions or the manufacturer’s instructions;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">e.  the Motor Vehicle being located, used, loaded, unloaded, transported on or over water, wharves, bridges or vessels of any kind;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">f.  lack of lubrication or a failure to properly service or maintain the Motor Vehicle;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">g.  collision with a bridge, carpark, awning, gutter, tree or any other overhead structure or object due to insufficient clearance;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">h.  overloading of the Motor Vehicle or any components thereof;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">i.  exposure to any Harsh Environments including corrosive or caustic substances, such as cyanide, salt water, acid;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">j.  vandalism;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">k.  any reason, in the case of tyres or tubes (including where other Motor Vehicle damage has occurred);\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">l.  any reason, in the case of windscreens, mirrors, glass or perspex (including where other Motor Vehicle damage has occurred);\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">m.  a truck mounted device; OR\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 140px;\">n.  the Motor Vehicle being driven on any road that is unsealed or is not a public road.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 80px;\">B.  In paragraph A, a reference to ‘You’ or ‘Your’ in sub-paragraph (a)-(d) includes any other driver of the Motor Vehicle or any passenger being carried in the Motor Vehicle.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">3).  For clarity, the LTD Waiver and the provisions of paragraphs 1) and 2) of this Special Condition 1.2 do not apply to truck or trailer mounted attenuators, as described in Special Condition 9.3.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  does not hold an appropriate licence to drive that class of Motor Vehicle;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">c.  is under the age of 18 years; or\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">d.  is affected by, or under the influence of, drugs and\u002For alcohol.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">1.5  You must provide Us with any information We request in accordance with the requirements of any relevant laws or authority including the licence or other details for those persons who will operate the Motor Vehicle.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">1.6  You will keep a record of all relevant details of any driver of a Motor Vehicle including: name, licence details, date and time that the driver used the Motor Vehicle.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">1.7  You will promptly pay all tolls, fines, penalties and other statutory or government charges arising out of Your use of the Motor Vehicle during the Hire Period. font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">2.6  You are responsible for the correct installation, calibration and use, as per the manufacturer’s instructions, of any attachments fitted to the Earthmoving & Compaction Equipment not supplied or installed by Us. You must seek approval in writing from Us if any attachments apart from those supplied by Us are to be fitted to the Earthmoving & Compaction Equipment.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">2.7  You are responsible for the theft of any Machine Control and Guidance Devices from the Earthmoving & Compaction Equipment. You must remove any detachable operator display or receiver of a Machine Control and Guidance Device from the Earthmoving & Compaction Equipment at the end of every shift and store it in a safe place.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">2.8  You are responsible for verifying the accuracy of any Machine Control and Guidance Device during the Hire Period. font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">d.  Undertake any necessary pre-drilling of well point holes;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">e.  Undertake any excavation, drilling or restoration necessary to ensure that the area for installation of the Pump or Dewatering Equipment is free of any obstruction (including rubble, road base, footpaths and fencing) and is suitable for the operation of the Pump or Dewatering Equipment;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">f.  Organise a power connection for the Pump or Dewatering Equipment if connecting from the main power line;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">g.  Provide a crane or excavator for the placement and removal of the Pump or Dewatering Equipment; and\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">h.  Provide Us with all relevant site information and any other information relevant to the safe delivery and installation of the Pump or Dewatering Equipment together with appropriate safe access to, and a safe work zone at, the site.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">4.4  You are responsible for instructing Us where to position the Pump or Dewatering Equipment at Your site. In the event that You instruct Us to place the Electronic Traffic Control Equipment or VMS Board, you warrant that you will provide Us with all information relevant and available for the safe placement of the Electronic Traffic Control Equipment or VMS Board.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">7.4  You acknowledge that in the event of a malfunction of:\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">a.  Portable Traffic Lights (whereupon the fail safe system will revert the Portable Traffic Lights to a flashing amber signal); or\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  a Portable Boom Barrier,\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">you will implement alternative traffic control operations (if applicable) in accordance with the requirements of any relevant laws or authority (such as engaging traffic controllers with STOP\u002FSLOW bats to perform traffic control for each portable boom barrier that has malfunctioned).\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">7.5  You will not use Electronic Traffic Control Equipment or VMS Board for advertising, political, personal or marketing purposes or for any other purposes (or in any manner) where such use contravenes the requirements of any relevant laws or authority and any applicable Australian Standard(s).\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">7.6  You are liable (and We have no responsibility) all claims, damage, loss, costs and expenses in respect of:\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">a.  any incorrect use or placement of the Electronic Traffic Control Equipment or VMS Board; or\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  Your use or operation of the Electronic Traffic Control Equipment or VMS Board.\u003C\u002Fp>",{"_metadata":307,"Title":311,"SubTitle":312,"Description":313},{"key":308,"displayName":309,"types":310},"26f5b06cd3824ee881898b9dd96d0d67","8. Traffic Safety Barriers & End Treatments",[247,38,14,15],"Traffic Safety Barriers & End Treatments",{"html":21},{"html":314},"\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.1  Definitions\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">a.  \u003Cem>“End Treatment”\u003C\u002Fem> means a crumple zone or flaring at the end of a Traffic Safety Barrier and includes Absorb 350, Triton, Armorzone, Sloped (Taper) End, TAU II and Quadguard products.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  \u003Cem>“Traffic Safety Barrier”\u003C\u002Fem> means a barrier designed to resist penetration of an out of control vehicle and includes road authority approved water filled barriers, concrete barriers and steel barriers, and any screen attachments.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.2  You acknowledge that We have made the manufacturer’s operating and safety instructions and\u002For user manual for the Traffic Safety Barriers and End Treatments available to You to read and that You are responsible for ensuring all instructions are complied with at all times.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.3  You must provide a safe work zone, including implementing reasonable measures for the observation of safe speed limits by drivers, for the installation, removal and repair of the Traffic Safety Barriers and End Treatments and obtain all necessary approvals from any relevant authority or local council for such installation.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.4  You must provide traffic control, adequate lighting and sufficient room for the safe unloading, positioning, removal and repair of the Traffic Safety Barriers and End Treatments.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.5  If the Traffic Safety Barriers and End Treatments require pinning to the road surface, You must check for underground utilities and provide a report to Us stating that no services will be affected by the installation of the required anchor pins.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.6  You are responsible for filling water filled Traffic Safety Barriers and End Treatments with water and maintaining them with a full level of water in accordance with the manufacturer’s instructions. We will only be responsible for repairing or replacing leaking water filled Traffic Safety Barriers or End Treatments if notified within 48 hours of delivery. Leaks identified after this time must be fixed at Your cost.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.7  You are responsible for regularly checking and maintaining any screens that may be attached to the Traffic Safety Barriers so that they do not impinge on traffic or become a traffic hazard.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.8  We are not responsible for any time delays or damages for works not being completed on time if the original scope of works changes once equipment and \u002F or install staff are on site, or if events outside Our control, including inclement weather, adversely affect the site.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.9  You must advise Us of the start and finish lines for the Traffic Safety Barriers and the location of any intermediate anchors, bends and gates for the Traffic Safety Barriers to be installed.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.10  You must be present at the end of the installation of the Traffic Safety Barriers and End Treatments to sign off with Us that they are in the correct location.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.11  If We are required to re-instate the anchor pin holes left in the road, You must advise of the method of reinstatement at the time of the quotation being prepared, otherwise You may incur additional charges.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">8.12  The Traffic Safety Barriers are not supplied with reflective markers. We are not responsible for the accuracy of the details of such Services or for any loss or damage arising from Your use of or reliance on such Services. You are liable (and We have no responsibility) all claims, damage, loss, costs and expenses in respect of Your use of or reliance on such Services. It is Your responsibility to obtain Your own independent advice from a qualified professional in relation to the proper use of the HSLS for Your required purpose.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">10.5  Under no circumstances will We supply an operator to operate the HSLS on Your behalf.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">10.6  To prevent oil cross contamination, You must ensure that only Enerpac Oil is contained in the components that You attach to the HSLS. If the HSLS has been contaminated, You must immediately stop using the HSLS and notify Us.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">10.7  You are responsible for any contamination of the HSLS in the Hire Period, and You are liable for all costs We incur in decontaminating and repairing the HSLS. Prior to the commencement of the installation, You must at Your expense:\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">a.  Obtain all necessary approvals from any relevant authority or local council for the installation of the Power & HVAC Equipment and the supply and discharge of water;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  Isolate the power running through wires (either above or below ground) that are in close proximity to where the Power & HVAC Equipment will be positioned;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">c.  Undertake any site work necessary to ensure that the area for installation of the Power & HVAC Equipment is level, sufficiently spacious, free of any obstruction and suitable for the operation of the Power & HVAC Equipment;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">d.  Organise a power connection for the Power & HVAC Equipment if connecting from the main power line;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">e.  Provide a crane or excavator for the placement and removal of the Power & HVAC Equipment at Your expense, and\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">f.  Provide Us with all relevant site information and any other information relevant to the safe delivery and installation of the Power & HVAC Equipment together with appropriate safe access to, and a safe work zone at, the site.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">14.3  You are responsible for instructing Us where to position the Power & HVAC Equipment at Your site. We may refuse to collect or accept the Equipment if it cannot be moved safely or if it is not empty, clean and decontaminated. Scaffolding",[247,38,14,15],"Scaffolding",{"html":21},{"html":377},"\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">15.1  Definitions\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">a.  \u003Cem>“Scaffold”\u003C\u002Fem> or \u003Cem>“Scaffolding”\u003C\u002Fem> means a temporary structure intended to support access or working platforms in construction where work cannot be done on a ground floor or a finished floor, and includes individual components such as tubes, couplers, frames and other associated items.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  \u003Cem>“Works”\u003C\u002Fem> means any works or services performed or to be undertaken relating to the installation, assembly, erection, dismantling or demobilising of the Scaffolding at Your site, and including any movements or modifications of the Scaffolding during the Hire Period.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">15.2  You acknowledge that We have made the manufacturer’s operating and safety instructions and\u002For user manual and\u002For installation procedures and guidelines for the Scaffolding available to You to read, and that You are responsible for ensuring all instructions are complied with at all times.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">15.3  Prior to the commencement of the delivery and hire of the Scaffolding, You must at Your expense obtain all necessary approvals from any relevant authority or local council.\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">15.4  We do not provide any Works for Scaffolding. You acknowledge and agree that You are responsible for performing all Works and, without limitation, ensuring compliance with the following:\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">a.  Works shall be performed in accordance with all applicable laws, regulations, guidelines and Australian Standards including safety guidelines (including working at heights);\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">b.  You and Your contractors shall hold the relevant class of Licence to Perform High Risk Work where required and shall have completed any mandatory training.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">c.  You and Your contractors performing the Works shall take all relevant factors into account as required of any skilled and experienced contractor in accordance with best industry practice, including ground conditions, wind loading, stability and bracing, containment, tie-downs and anchoring, weather, actions of third parties, adjacent structures and Scaffolding damage.\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">d.  All Scaffolding shall remain compliant during the Hire Period and is not used in an unsafe manner;\u003C\u002Fp>\n\u003Cp style=\"color: rgb(80, 80, 80); font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px; padding-left: 40px;\">e.  On-going site inspection shall be undertaken to ensure that there have been no changes during the Hire Period which may affect the Scaffolding or the Works;\u003C\u002Fp>\n\u003Cp style=\"color: #505050; font-family: 'Neue Haas Grotesk Display Pro'; font-size: 16px; font-style: normal; font-weight: 500; line-height: 24px;\">15.5  You are liable for (and You indemnify Us against) all claims, damage, loss, costs and expenses in respect of Your performance of the Works and as a result of Your breach of, or in connection with, this clause.\u003C\u002Fp>","Special Conditions Of Hire - Coates","View the additional Special Conditions of Hire that are part of your agreement when you hire from us.
